Terms of Service

Welcome to HullDocs, a service of Casting Karma LLC (“HullDocs,” “we,” “us”). By creating an account or using the service you agree to these terms. Please read them — Section 10 requires most disputes to go to individual arbitration and waives class actions, and you can opt out of that within 30 days.

1. What HullDocs is

HullDocs helps you record and organize a boat's maintenance history, documents, and reminders, and share that record with others (for example, a buyer). HullDocs is a record-keeping tool. It documents what you enter — it does not verify, appraise, inspect, or vouch for the condition or value of any boat. A HullDocs record is not a survey, an inspection, a title search, or a warranty. Any resale-value or market statements are general information, not a guarantee.

2. Your account

You must provide accurate information and keep your login secure. You're responsible for activity under your account. You must be at least 18 years old to create an account.

3. Your content, and what happens when a boat is sold

You own what you add. You keep ownership of the records, photos, and documents you upload.

You grant us a licence to run the service. You grant Casting Karma LLC a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and transmit your content solely to operate and provide HullDocs to you and to the people you direct us to share it with. This licence ends when you delete the content, except as described below.

You're responsible for what you upload. You represent that you have the right to upload each item and to include any third-party information in it (for example, a repair shop's name, a surveyor's name, or an invoice containing someone else's details), and that your entries are accurate to the best of your knowledge.

The record travels with the boat. HullDocs exists so a boat's history survives a change of owner. So:

Published records work the same way. If you publish a record to a public link or QR code, copies that others have already viewed, saved, or cached are outside our control and cannot be recalled.

4. Acceptable use

Don't misuse the service: no unlawful, infringing, or fraudulent content; no attempts to break, overload, scrape, or reverse-engineer the platform; no uploading of others' private information without permission.

Inviting other people. HullDocs will, on your instruction, email a repair shop (to confirm work) or a buyer (to claim a transferred record). When you give us someone's email address, you represent that you have an actual relationship with that person or business and the right to give us their address for this purpose. Do not use these invitations to send unsolicited mail, marketing, or anything the recipient would not expect. We may refuse, rate-limit, or stop sending invitations, and we honor any recipient's request never to be emailed again.

5. Plans, billing, and refunds

Free and paid plans. HullDocs offers a free tier (one boat, up to 10 documents) and Captain, a paid subscription.

Subscriptions. Captain is billed in advance at the price shown at checkout and renews automatically until you cancel. You can cancel anytime from your account; cancellation takes effect at the end of the period you've already paid for, and you keep Captain access until then. We'll tell you before any price change takes effect, and you can cancel rather than accept it. Taxes may apply. Subscription fees already paid are non-refundable except where required by law — but you can always cancel to avoid the next renewal.

If a payment fails. If a renewal payment fails, we keep your Captain access active while your card issuer and our payment processor retry (typically up to about three weeks). If the payment ultimately doesn't clear, the subscription cancels and your account returns to the free plan.

What happens on downgrade — we do not delete your records. If you drop to the free plan (by cancelling or by non-payment), paid features stop: no AI import or document filing, no new shop-confirm links, no included sale reports. Your existing boats, service records, photos, and documents are retained and remain viewable and exportable — you simply can't add beyond the free limits until you upgrade again. We do not delete your content because a payment failed.

Sale Report — one-time purchase, and the refund rule. A Sale Report is a one-time $35 purchase for a single boat. It is a digital product generated and delivered to you immediately on payment. Because it is delivered instantly, a Sale Report is non-refundable once it has been generated. You may re-download a Sale Report you've purchased at any time at no additional charge, and we will not charge you twice for the same boat.

The exception — if it's broken, we fix it or refund it. If the report fails to generate or deliver, is corrupted, or is materially wrong through our fault (for example, it's the wrong boat), email support@hulldocs.com within 14 days and we will re-issue it or refund you in full. Nothing in this section limits any refund right you have that cannot be waived under the law where you live.

6. Shop confirmations, sharing, and public records

Shop confirmations. A record may be marked “shop-confirmed” when a service provider confirms it. A confirmation reflects what that party stated. It is not our independent verification, and we do not check the shop's identity, licensing, or the quality of its work.

Sharing you control. Your records are private by default. You choose what to share.

Public records and QR codes. If you publish a boat's history to a public link or QR sticker, anyone who has that link or scans that code can view it, without signing in. Treat it as public. Before you publish, remember the record may contain third-party names and business details from your invoices — by publishing, you confirm you have the right to make that information public. You can unpublish a record at any time, which disables the link going forward; as noted in Section 3, it cannot recall copies already viewed or saved.

7. AI features

If you choose to use AI import or AI document filing, you are asking us to send that document or image to our AI provider (OpenAI) to read it and propose a draft record. AI features only run when you trigger them. What comes back is a draft you review and confirm — HullDocs does not save an AI-extracted record without you accepting it. AI output can be wrong; you are responsible for checking it before you save it. Your content is not used to train the AI provider's models. See our Privacy Policy for the details.

8. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that any record, document, shop confirmation, or AI-generated draft is accurate, complete, or suitable for any purpose — including buying or selling a boat.

Decisions you make about a vessel are yours. A HullDocs record is not a substitute for a marine survey, a mechanical inspection, or a title search.

9. Limitation of liability

To the fullest extent permitted by law, Casting Karma LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost data, or loss arising from a boat purchase or sale, even if we've been advised of the possibility.

Our total liability for all claims relating to the service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) one hundred U.S. dollars ($100).

Nothing here excludes or limits liability that cannot be excluded or limited under applicable law — including liability for fraud, or for death or personal injury caused by negligence. Some jurisdictions don't allow certain exclusions, so parts of this section may not apply to you.

10. Dispute resolution — arbitration and class-action waiver

Please read this section carefully. It affects your legal rights, including your right to go to court and to have a jury trial.

Let's talk first. If something goes wrong, email legal@hulldocs.com and give us 30 days to try to resolve it. Most things end here.

Individual arbitration. If we can't resolve it, you and Casting Karma LLC agree that any dispute arising out of or relating to HullDocs or these terms will be resolved by final, binding, individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Texas — or, at your election, conducted by telephone or video, or in your home county where the AAA rules allow.

Class-action waiver. You and we each waive any right to bring or participate in a class, collective, consolidated, or representative action. The arbitrator may award relief only to you individually.

What's carved out. Either of us may bring an individual claim in small-claims court instead. Either of us may ask a court for an injunction to protect intellectual property or stop unauthorized access to the service.

🚪 YOUR 30-DAY OPT-OUT. You can opt out of this entire Section 10 — arbitration and the class waiver — by emailing legal@hulldocs.com with the subject line “Arbitration Opt-Out” within 30 days of first accepting these terms. Include your account email. Opting out costs you nothing, changes nothing else about your account, and we will not hold it against you. If you opt out, Section 11 (courts in Texas) governs your disputes.

This section does not waive any right that cannot be waived under the law.

11. Governing law and venue

These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws rules. For any dispute not subject to arbitration under Section 10 (including if you opt out), you and we consent to the exclusive jurisdiction of the state and federal courts located in Texas.

12. Copyright and takedown requests

If you believe content on HullDocs infringes your copyright, or that a published record contains your personal or business information and should be removed, email removals@hulldocs.com with enough detail for us to find it (the link, what the content is, and why). We review takedown and removal requests in good faith and will respond within a reasonable time. We may remove or disable content at our discretion, and we may terminate the accounts of repeat infringers. Our designated agent for copyright notices under the DMCA can be reached at removals@hulldocs.com.

13. Changes and termination

We may update the service and these terms. If we make a material change, we'll post it here with a new version and date, and ask you to accept it the next time you sign in. You may stop using HullDocs at any time. We may suspend or terminate accounts that violate these terms, and we may suspend paid features for non-payment as described in Section 5. If we terminate your account without cause, we'll give you a reasonable chance to export your records.
